JUNE 29, 2005
Case # 178A Malachy Glen Associates, Inc. requesting a Motion For Rehearing.
Members Present: Edward Meehan, Chairman; Jeff Jordan; Stephen MacCleery, Ex-Offico; David Dobson; Mark McIntosh, Vice Chairman.
Ed Meehan opened the public meeting so the members could discuss the motion for rehearing requested by Malachy Glen Associates, Inc. Jeff Jordan moved and Mark McIntosh seconded to go into executive session to discuss attorney/client privilege pertaining to this case according to RSA 91-A:3,II. A roll call vote was taken of the members:
Jeff Jordan – Yes
Ed Meehan – Yes
Stephen MacCleery – Yes
David Dobson – Yes
Mark McIntosh – Yes
Board went into executive session with no minutes or any action being taken.
Steve MacCleery moved and Mark McIntosh seconded to come out of executive session where no action was taken. A roll call vote was taken of the members:
Jeff Jordan – Yes
Ed Meehan – Yes
Stephen MacCleery – Yes
David Dobson – Yes
Mark McIntosh – Yes
Steve MacCleery moved to deny the appeal of Malachy Glen Associates, Inc. for a rehearing after discussion with town attorney and the BOA on the basis that the BOA has done nothing illegal, has applied all procedures properly and didn’t make any errors in so doing. Motion was seconded by Jeff Jordan.
Board Discussion – Mark feels the board has gone through the proper procedures and no new evidence has been brought forward by the applicant. Ed was in agreement.

Motion carried 5-0. Application for rehearing has been denied.
